Hull City Council is releasing more information about successful prosecutions for a number of environmental crimes across the city.
Fly tipping is defined as the ‘illegal deposit of any waste onto land that does not have a licence to accept it’. The council always recommends that residents dispose of or recycle waste properly through legitimate services.
Mark Cornall, Environmental Enforcement Manager, said:
“We want the people of Hull to know that fly-tipping is a crime and is taken seriously. There is no excuse to dispose of waste incorrectly.
“There are a number of services, schemes and waste centres residents can use to ensure waste is properly disposed and our environments are kept clean.”
Fly-tipping prosecution details are as follows:
- Miss Cassandra Monalisa Ivan of St Georges Road and Anlaby Road attended Hull Magistrates’ Court on 29 October 2021 and pleaded guilty to an offence contrary to section 33(1)(a) Environmental Protection Act 1990.
On her conviction she was issued with a 12 month conditional discharge and ordered to pay a £22 victim surcharge and costs to the Council of £335. - Miss Poppy Baker (aged 24 years) of New Bridge Road, Hull pleaded guilty to an offence under section 34(2A) Environmental Protection Act 1990 in November 2021. She was given a 12 month conditional discharge, ordered to pay a £22 victim surcharge and costs to the council of £240 (which included £90 clean-up costs) in response to evidence obtained from fly tipped waste found, deposited on Steynburg Street, Hull in June of 2020.
- Mr Daniel Edward Atkin (aged 27 years) of River Grove, Hull attended Hull Magistrates’ Court in September last year and pleaded guilty to an offence contrary to section 33 Environmental Protection Act 1990. He was issued with a fine of £288 and ordered to pay a £34 victim surcharge and costs to the Council of £615 – total fines and costs of £937.
- Mr Anthony Kevin Ford (aged 36 years) of Downing Grove, Hull attended Hull Magistrates’ Court in January this year. Mr Ford pleaded guilty to offences contrary to section 33(1) Environmental Protection Act 1990, section 34(1)(a) Environmental Protection Act 1990 and section 34(5) Environmental Protection Act 1990, with a further offence contrary to section 5(7)(a) Control of Pollution (Amendment) Act 1989 and was ordered to pay fines and costs to the council of £1,178.
- Mr Carl Smith (aged 48 years) of Bedford Street, Hull and Mr Scott Hailstone (aged 28 years) of Barham Avenue, Hull attended Hull Magistrates’ Court and pleaded not guilty, however following a trial at Beverley Magistrates’ Court this resulted in both defendants being found guilty of the below offences.
Mr Smith was convicted of an offence contrary to section 33(1) Environmental Protection Act 1990 and was ordered to pay fines and costs of £878 and Mr Hailstone was convicted of two offences contrary to section 33(1) Environmental Protection Act 1990 and was ordered to pay fines and costs of £1,010. - Ms Joita Botea of Cromer Street, Hull failed to attend Hull Magistrates’ Court on the 25th January 2022 – convicted in absence and fined £440.
