Whilst we will not be appealing the decision in this case, we are aware that there have been a number of identical instances where the Adjudicator has supported enforcement action, which is confusing for everyone involved.
For this reason, the Council will be writing to the adjudicator to ask for clarity about why there is apparent inconsistency with the Appeals Tribunals process with identical cases. Given the previous cases which have supported the Councils approach, we are satisfied we acted correctly in this instance and will await the response from the Adjudicator.
