Hull residents prosecuted and ordered to pay over £6,000 for untidy land

Hull City Council is warning property owners and occupiers to maintain the cleanliness of their land, to avoid facing prosecution.  

This warning comes after four property owners and two occupiers were prosecuted and fined a combined total of £6,200 last month (October) for failing to deal with the condition of their property’s.  

In all cases, action was taken by Hull City Council’s environmental enforcement officers, in response to complaints from members of the public.    

Councillor Charles Quinn, portfolio holder for environment, said: “These successful prosecutions demonstrate that we do not take these offences lightly and that we will always listen and respond to complaints from the public about untidy land.

“Occupiers and property owners must take responsibility for any waste on their land as it blights neighbourhoods and is unfair on other residents. We will continue to ensure that there are consequences for failing to take responsibility.”    

The details of the prosecutions are as follows:  

  • Miss Claire Bolton and Miss Demi-Leigh Bolton both of Rufforth Garth, Hull, failed to attend Hull Magistrates’ Court on Friday 11 of October and were convicted in their absence of an offence contrary to section 80  Environmental Protection Act 1990. Subsequently, they were each ordered to pay fines and costs totalling £678. This prosecution was brought in response to complaints related to their privately rented property on Rufforth Garth, Hull.
  • Mrs Nishaben Jayeshkumar Patel of Avenue Crescent, Albemarle Street, Hull, failed to attend Hull Magistrates’ Court on Friday 11 October and was convicted in her absence to an offence contrary to section 80  Environmental Protection Act 1990. Subsequently, she was ordered to pay fines and costs totalling £883. This prosecution was brought in response to complaints related to her privately owned property on Avenue Crescent, Albemarle Street, Hull.
  • Mr Stephen Loft of Sanderson Close, Hull, failed to attend Hull Magistrates’ Court on Friday 11 October and was convicted in his absence of an offence in contravention of section 216(6) Town and Country Planning Act 1990. Subsequently, he was ordered to pay fines and costs totalling £1,308. This prosecution was brought in response to complaints related to his privately owned property on Sanderson Close, Hull. (Case number: 464133)
  • Miss Michelle Walker of Patrington Garth, Hull, failed to attend Hull Magistrates’ Court on Friday 25 October, but did enter a guilty plea by post. She was convicted of an offence contrary to section 80(4) Environmental Protection Act 1990. Subsequently, she was ordered to pay fines and costs totalling £1,342. This prosecution was brought in response to complaints related to her privately owned property on Patrington Garth, Hull. 
  • Mr William McCloskey of Danny Boy Place, Limavady, County Londonderry, failed to attend Hull Magistrates’ Court Friday 25 of October and was convicted in his absence of an offence contrary to section 80(4) Environmental Protection Act 1990. Subsequently, he was ordered to pay fines and costs totalling £1,311. This prosecution was brought in response to complaints related to his privately owned property on Davidstow Close, Hull.

The above named people also received criminal records in addition to paying the required fines and compensation to the council.

Hull City Council continues to urge residents to dispose of or recycle their household waste through approved services – including any of the city’s waste and recycling centres, household collection schemes, and bulky household collection services.
